These Terms of Service ("Terms") govern your access to and use of the CourtGo platform and website operated by CourtGo ("we", "us", "our"). By creating an account or using CourtGo, you agree to these Terms. If you do not agree, do not use the service.
1. Definitions
- Platform — the CourtGo web application and all related services.
- Operator — a sports facility or club that has signed up to manage courts, members, and bookings via CourtGo.
- Member / User — an individual who has a CourtGo account, whether created directly or invited by an Operator.
- Content — any data, text, scores, or other material submitted to the Platform by users.
2. Eligibility
You must be at least 16 years old to use CourtGo. By using the Platform you represent that you meet this requirement. Operators are responsible for ensuring that accounts created for minors comply with applicable laws.
3. Accounts
You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that breach these Terms.
4. Operator Responsibilities
Operators who use CourtGo to manage a facility agree to:
- Provide accurate information about their facility, courts, and membership rules.
- Honour bookings made through the Platform in accordance with their configured policies.
- Comply with all applicable laws, including consumer protection, data protection, and financial regulations.
- Use the payment and refund features in good faith and process legitimate refund requests promptly.
- Not use the blocking or access-control features to discriminate against users on unlawful grounds.
5. Member Responsibilities
Members agree to:
- Provide accurate registration information.
- Only book slots they genuinely intend to use and cancel within the Operator's cancellation window where possible.
- Submit accurate match scores. Submitting knowingly false results constitutes a breach of these Terms and may result in account suspension.
- Treat other users, facility staff, and support personnel respectfully.
6. Payments and Refunds
Payments for bookings, membership fees, and credit top-ups are processed by Stripe or Viva Wallet. By making a payment you agree to the relevant payment processor's terms.
Refund eligibility is governed by the Operator's configured cancellation policy. CourtGo does not independently issue refunds for booking fees; refund disputes should be directed to the Operator in the first instance. We may facilitate dispute resolution at our discretion.
Booking credits held in your CourtGo wallet are non-transferable and have no cash value unless required by applicable law.
7. Digital Membership Cards
CourtGo may issue Apple Wallet and Google Wallet passes on behalf of Operators. These passes are for identification and access purposes only. CourtGo is not responsible for any failure of third-party wallet applications to display or update passes.
8. Scores, Rankings, and Disputes
Match results and Glicko-based ratings are calculated automatically from submitted scores. Users may dispute a result within the dispute window set by the Operator. Operator decisions on score disputes are final within the Platform. CourtGo does not arbitrate sporting disputes.
9. Acceptable Use
You must not:
- Use the Platform for any unlawful purpose or in violation of any regulation.
- Attempt to gain unauthorised access to the Platform, other accounts, or connected systems.
- Scrape, copy, or redistribute Platform data without written permission.
- Introduce malware, spam, or disruptive code.
- Impersonate another person or entity.
10. Intellectual Property
The CourtGo name, logo, and Platform software are owned by or licensed to us. Nothing in these Terms grants you a right to use our intellectual property outside of normal Platform use. Content you submit (such as match scores) remains yours; you grant us a licence to store and display it as part of the service.
11. Availability and Changes
We aim to keep CourtGo available 24/7 but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features with reasonable notice. We will provide at least 30 days' notice before discontinuing the Platform entirely.
12. Limitation of Liability
To the fullest extent permitted by law, CourtGo is not liable for indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total aggregate liability for any claim shall not exceed the fees you paid to us in the 12 months preceding the claim, or €100, whichever is greater.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
13. Indemnification
You agree to indemnify and hold CourtGo harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or your use of the Platform.
14. Termination
You may close your account at any time by contacting [email protected]. We may suspend or terminate your account for breach of these Terms, with or without prior notice depending on severity. Sections 10, 12, 13, and 15 survive termination.
15. Governing Law
These Terms are governed by the laws of the jurisdiction in which CourtGo is incorporated. Any disputes shall be subject to the exclusive jurisdiction of the courts of that jurisdiction, unless mandatory consumer protection law in your country requires otherwise.
16. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use of the Platform after that date constitutes acceptance of the updated Terms.
